Terms of Service

Fair rules. Plain English.

Last reviewed: May 6, 2026. By using this website you agree to these terms. Project work itself is governed by the signed quote/contract for that specific project, not these site terms.

1. Who we are.

“Frank & Sons Paving,” “we,” “us,” and “our” refer to Frank & Sons Paving, a California paving contractor based in San Diego County. “You” means anyone using frankandsonspaving.com or requesting an estimate.

2. Estimates are not contracts.

Free estimates submitted through this website or given verbally are good-faith assessments based on the information you provided. They’re not contracts. The actual work is governed by a signed written quote/contract for the specific project, which incorporates final scope, price, schedule, warranty, and any change-order procedure.

An estimate may change once we walk the property in person, see actual base condition, encounter unforeseen subgrade issues, or your scope changes.

3. Photos and project information.

We may photograph completed projects (without identifying you, your address, or any people) for portfolio and marketing use. If you do not want photos of your project used this way, tell us when we book the work and we’ll honor that.

4. Warranty.

Our standard 5-year written workmanship warranty applies to qualifying commercial overlay and full-depth jobs. Specific warranty terms are stated in the signed contract for that project. The warranty does not cover damage from earthquakes, floods, vehicle gas/oil leaks, vehicle accidents, or use exceeding the lot’s designed weight class.

5. Intellectual property.

Site content, photos, copy, and design are the property of Frank & Sons Paving. You may share or quote with attribution; you may not copy the site to brand a competing paving company.

6. Disclaimers.

The site is provided “as is.” We do our best to keep information accurate, but we don’t warrant that it will be error-free or always up to date. Pricing examples are illustrative; your project price comes from your written estimate.

7. Limitation of liability.

To the fullest extent allowed by California law, our total liability for any claim arising out of or related to your use of this site (separate from a signed project contract) will not exceed $100. Liability for project work is governed by the signed contract for that work.

8. Governing law and venue.

These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Any dispute arising out of or related to these terms or your use of the site will be resolved in the state or federal courts located in San Diego County, California, and you consent to personal jurisdiction in those courts. Disputes arising from a signed project contract are governed by the dispute-resolution clause in that contract.

9. Severability and entire agreement.

If any part of these terms is unenforceable, the rest remains in effect. These terms, with the Privacy Policy, are the entire agreement between you and Frank & Sons Paving regarding this website.

10. Changes.

We may update these terms. Continued use of the site after changes means you accept the updated terms. The “Last reviewed” date at the top reflects the most recent version.
